Terms & Conditions

1. Introduction
By signing this agreement, you acknowledge and accept the services, pricing, and terms outlined by Endeavor Heating and Cooling LLC, a registered Limited Liability Company in the state of Washington.
2. Proposal Validity
This proposal remains valid for 30 days unless otherwise specified. Endeavor Heating and Cooling LLC reserves the right to modify or withdraw this proposal at any time prior to acceptance.
3. Scope of Work
The scope of work is based on the assessment conducted by Endeavor Heating and Cooling LLC, as outlined in the signed estimate. Any modifications or additional work outside the agreed scope require prior written approval from the paying party.
4. Unforeseen Circumstances
If unexpected conditions arise that alter the scope or cost of work, Endeavor Heating and Cooling LLC will provide a detailed explanation. The paying party must approve and sign an updated estimate before any additional work begins.
5. Appointment Cancellations
Service Appointments: Cancellations within 24 hours of the scheduled appointment will incur a $75 fee. The first cancellation within 24 hours will be waived as a courtesy.
Installations: Cancellations after the deposit has been paid will incur a 20% cancellation fee of the total job cost. Deposits are non-refundable after materials have been ordered. If work is canceled after materials have shipped or been picked up, a restocking fee of up to 25% may apply depending on supplier policy.
6. Membership Cancellation & Refund Policy
Prorated refunds for mid-term cancellations are available, subject to a 30% processing fee. Unused service credits are non-refundable but may be applied toward other services within 90 days of cancellation.
7. Licensing & Compliance
Endeavor Heating and Cooling LLC is a licensed and bonded HVAC contractor in Washington State, adhering to all regulations set forth by the Washington State Department of Labor & Industries and federal law.
8. Liability Disclaimer
Endeavor Heating and Cooling LLC is not responsible for pre-existing conditions or damages to equipment prior to service, or for damages caused by customer negligence or third parties.
9. Transparent Pricing
All rates and costs are disclosed upfront. If pricing adjustments become necessary, Endeavor Heating and Cooling LLC will seek prior approval and written consent from the paying party before proceeding.
10. Payment Terms
Payment is due upon completion unless otherwise agreed. Late payments over 30 days will incur a 12% annual interest rate. Unpaid accounts after 90 days may be referred to collections. Credit card chargebacks without first contacting us are considered a breach of contract.
11. Customer Responsibilities
Customers must provide clear and safe access to the service area, disclose hazards, and ensure water and power are accessible. Pets should be secured during service.
12. Force Majeure
We are not liable for delays caused by uncontrollable events like natural disasters, pandemics, strikes, or government restrictions.
13. Professional Standards
We commit to providing high-quality HVAC service in compliance with industry best practices and legal standards.
14. Governing Law & Jurisdiction
These terms are governed by Washington State law. Disputes will be resolved in Snohomish County, WA.
15. Terms Modification
We may update these terms and will communicate any major changes. Updated terms will be documented on revised estimates.
16. Warranty Coverage
Maintenance Members: One-year parts and labor warranty. Non-members: 90 days. Installations: One-year labor warranty. Manufacturer warranties apply where available.
17. Pre-Existing Conditions & Third-Party Work
We are not responsible for issues caused by others or prior installations. This includes code violations or concealed defects.
18. Dispute Resolution
Disputes will first go through negotiation or mediation. If unresolved, binding arbitration may be used per Washington law.
19. Insurance & Bonding
We maintain all required insurance and bonding as mandated for licensed HVAC contractors in Washington.
20. Consumer Protection Compliance
We adhere to Washington’s Consumer Protection Act to ensure ethical and transparent service practices.
21. Right to Refuse Service
We reserve the right to refuse service in unsafe, unsanitary, or hostile environments.
22. Safety Standards & Code Compliance
All work is performed to meet or exceed building code requirements. Necessary corrections for code violations may incur extra cost.
23. Authorization to Perform Work
By signing an estimate or work order, the customer authorizes Endeavor Heating and Cooling LLC to perform the agreed work on the property.
24. Digital Communications & Consent
You consent to receive service-related messages via email, phone, or SMS. Reply “STOP” to opt out of text messages. Standard rates may apply.
25. Photos & Documentation
We may take photos for internal records, training, or marketing. Personal info will not be published without your permission.
26. Permits & Inspections
Permit costs and inspection coordination are the homeowner's responsibility unless otherwise agreed. We assist in facilitating this process.
27. Limit of Liability for Refrigerants & Environmental Conditions
We are not liable for refrigerant loss or damage caused by environmental conditions like flooding, pests, or corrosion.
28. Privacy & Data Use
Personal info is collected solely to deliver HVAC services. We never sell data and only share with trusted vendors. You may request data access or deletion at any time.
29. Emergency Services
Emergency services may include extra fees. We will prioritize response based on severity and availability.
30. Signatures and Binding Agreement
Acceptance of service, estimate approval, or membership enrollment constitutes agreement to these terms. Electronic signatures are legally binding under Washington and federal law.
